Protected Classes Under the EEOC
The EEOC oversees the enforcement of anti-discrimination laws such as the
Civil Rights Act of 1964, the Equal Pay Act of 1963, and the Age Discrimination
in Employment Act of 1967. These laws and others establish what are known
as “protected classes,” or personal characteristics that may
not be discriminated against in the workplace. This includes hiring and
firing, compensation, promotions, and recruitment.
Protected classes are as follows:

- Disability status
- Veteran status
Sexual orientation is not a protected class, though recent developments
show that the EEOC may rule in favor of LGBT employees in discrimination
cases. A July 2015, an EEOC ruling on
David Baldwin v. Dep’t of Transportation deemed discrimination against sexual orientation to be in essence discrimination
because of sex, which is a protected class. Employers are not bound by
this decision, though this decision could be a sign of a coming trend.
